Kluck was convicted and sentenced for the offense of identity theft. He was placed on probation. As part of the probation agreement, he was not allowed to vote. According to Dakota County Auditor's records, Kluck voted Nov. 4, 2008, while still on probation. Statutes indicate a person may not assist more than 6 voters or be in possession of more than 10 ballots. The prosecution filed an order nolle prosequi in February 2014 and the case was dismissed. Using Election Day Registration, Kaarbo voted at a polling place in Skelton Township, at which time she completed a voter registration application and signed a certification saying she was eligible to vote. when in fact her voting rights had not been restored. Carlton County Auditor/Treasurer Paul Gassert said that because the voter's ineligiblity was discovered after the fact, there was no way to prevent the fraudulent vote from counting.
