Voting by non-registered individuals This type of voting irregularity occurs when an individual who is not registered to vote in Philadelphia at the time of an election casts a vote. Evidence in this report shows individuals who were not registered voters at the time of the 2012 primary, yet still cast votes included in the Certified Election Results. 2. Voting by individuals in the incorrect party’s Primary This type of irregularity is one of the most common irregularities that occur in Primary Elections in Philadelphia. A division in which all non-Democratic voters cast votes for candidates in the Democratic Primary is examined in this report. 3. Divisions with more votes than voters This type of voting irregularity occurs when more votes are cast on the Voting Machines than voters who showed up to the polls. We examined a division where either 6 unknown voters were able to vote without signing in, or at least one person voted more than once. 4. Voting by individuals in the incorrect legislative district This type of voting irregularity refers to voters casting votes on the Voting Machines in a legislative district that does not include the division in which the voter is registered. Examples of voters casting votes in districts other than their own are included in this report. 5. Individuals voting more than once This type of voting irregularity occurs when a voter is able to vote more than once in the same election. Evidence in this report confirms an example of an individual who voted twice, illegally in the 2012 Primary. 6. Voter impersonation This kind of voting irregularity occurs when one individual impersonates another and is able to vote in place of the person whose name appears in the Poll Book. This report contains evidence of one such example. 7. Voting by non-U.S. citizens In 2012 alone, the Philadelphia City Commissioners have already been made aware of 19 non-U.S. citizens registered to vote in Philadelphia County. Seven have voted in at least one election, as recently as the 2012 Primary. |Texas||Charles Roaches||Russell Grant||M||2009-05||Gonzales municipal||2011-02||Absentee/mail||Voter intimidation/coercion||Ballot tampering||4||4||Charles Roaches was indicted in February 2011 on 4 counts of voter fraud for providing false information on an application for early voting in the May 2009 Gonzales City Council election, along with Russell Grant, indicted on 10 counts. Dozens of Gonzales citizens said then-candidates Grant and Roaches gave them misleading information and possibly tampered with their mail-in ballot applications. City Voting Officer Jean Collins said 83 of 102 mail-in ballot applications received listed "disability" as the reason for voting by mail. Several voters named on the applications contended they are not disabled and never voted by mail. In February 2010, Grant admitted to “voter misconduct” and agreed to resign his District 2 council seat, abstain from public office, and cooperate with authorities in the voter fraud investigation. |Tennessee||Gayle Copeland||F||Registration Fraud||11||Gayle Copeland was accused of 11 counts of illegal voter registration, false entries, criminal impersonation and food stamp fraud. One count each of illegal registration, false entries and criminal impersonation were dismissed, as well as three counts of food stamp fraud. Copeland pleaded guilty to and was charged with two counts of illegal registration or voting, one count of criminal impersonation and one count of food stamp fraud.||2 years suspension and restitution in the amount of $4,694 to the Department of Human Services. |Texas||Irene Rodriguez||Chris De Leon||F||2014-06||Mercedes municipal runoff||Absentee/mail||Illegal assistance||3||Irene Rodriguez, the wife of Mercedes City Commissioner and mayoral candidate Rudy Rodriguez, and Chris De Leon, the owner of the adult daycare that disabled senior Yolanda Gonzales attended, entered Gonzales' home, opened mail-in ballots for the June 2014 City Commission runoff, and instructed Gonzales how to complete her own ballot. The two women then instructed Gonzales to complete and sign the ballots of her mentally-impaired brother Rene Gonzales and her 88-year-old bedridden father Jose Gonzales, who weren’t home. It’s illegal to cast someone’s vote for them without their knowledge and to instruct someone how to vote as they are voting. It is also against the law to mark their ballot or take it to the mail for them without signing as a voter assistant. Describing the incident, Yolanda Gonzales — who, at 64, suffers from various disabilities — didn’t seem to understand that what she had done was wrong. She said she had just followed the instructions of the campaign workers, who told her she was allowed to mark votes for her father and brother. |Virginia||Mark Winfield Atwater||2007 2008||2013-04||Registration fraud - ineligible felon||1||0||In April 2013, a grand jury indicted Mark Winfield Atwater and five other convicted felons on charges of giving false statements when registering to vote. The registrations occurred in 2007 and 2008. The six were each indicted on a felony count of election fraud: Mark Winfield Atwater of Portsmouth; James Edward Dorsey of Portsmouth; Brenda Lee Harris of Virginia Beach; Tyrone Stith of Chesapeake; Lisa Charlotte White of Portsmouth; and Delphine Williams of Portsmouth.
