It is a felony to possess or return absentee ballots unless you are the person voting, the voter's family member, a mail carrier, or an authorized official. Texas Jose Picasso Salvador Vela 2010-05 Alton municipal Registration fraud Ineligible district voting Leading up to the 2010 Alton city election, 23 voters registered their residency at mayoral candidate Jose Picasso’s home on North Eagle Pass Street. In December 2012 two women were charged with illegal voting for falsely listing Picasso’s home as their residence to vote in the 2010 Alton election. Both were convicted. The city, which ran the 2010 election, found more than three dozen suspicious votes. Teresa Ruiz) D 2009-08 Absentee/mail Impersonation Forgery Angel Colon, an employee of the City of Newark Office of Affirmative Actiona and former campaign worker for state Sen. Teresa Ruiz (D-Essex), was sentenced to three years in prison for submitting fraudulent ballots in her 2007 election. Colon, pleaded* guilty to election fraud in July 2011, admitting he submitted messenger ballots on behalf of voters in the Essex County-based 29th District without their knowledge. In January 2012, state Superior Court Judge Thomas Sumners Jr. sentenced Colon to five years probation. The Attorney General's Office sought three years in prison, consistent with a plea bargain that had been struck, and the appellate court agreed, saying the crime required Colon to serve prison time. The standard is five to 10 years in prison. "Justice demanded that Colon serve a state prison sentence, in accordance with his guilty plea,” acting state Attorney General John Hoffman said. Teresa Ruiz) D Absentee/mail Impersonation Forgery John Fernandez, 61, of Belleville, was found guilty by a Mercer County jury of submitting ballots on behalf of voters in the Nov. 6, 2007, general election without their knowledge. The jury convicted him of conspiracy, election fraud, absentee ballot fraud, tampering with public records or information and forgery. He helped collect ballots on behalf of Teresa Ruiz, who won the election and still serves in the Senate. Teresa Ruiz) D Absentee/mail Ballot tampering Gianine Narvaez, 39, pleaded guilty in March 2010 to third-degree charges of absentee ballot fraud and tampering with public records or information. Narvaez, a former data processing technician for the Essex County Commissioner of Registration and Superintendent of Elections, has forfeited her job and public pension, and also is barred from public employment in New Jersey.
