Under the plea agreement, a second count involving another vote cast in the wrong district in 2008 was dismissed. Malszycki, a legislative aide to state Rep. Warren Petryk (R-Eleva), was charged with voting in Onalaska, where she temporarily lived while doing campaign work, instead of in Madison where she resided. Ward worked for election contractor Stillwater LLC, which was enlisted to obtain signatures on campaign petitions for Republican candidate Newt Gingrich in Virginia's 2012 presidential primary.
