The man requested an absentee ballot on Oct. 23, and the ballot was returned to the elections board Nov. 3. The man then voted at his polling place Nov. 6. Elections board Director Paul Adams said the voting book at the polling location indicated that he already cast an absentee ballot but he was allowed to sign the book over where it said “absentee sent.” The presiding judge at the polling place told elections officials that she did not recall what happened with the voter, but Adams said her conduct also is under review. Karen Berry||2008-11||Pike County commission||2008-12||Election contest||Absentee/Mail||Ineligible district voting||10||After nearly a year in office, Pike County Commissioner Karen Berry was ordered to vacate her District 6 seat to challenger Oren Fannin when a judge ruled that 10 votes were cast illegally for Berry in the November 2008 election. Berry was originally declared the winner by a six-vote margin, but Fannin contested the results. All 10 illegal votes were cast by absentee ballot. Three invalid ballots were stipulated by both parties, since Carl, Mary and Brandon Kidd cast absentee ballots for Berry but lived outside District 6. Another three voters - Tiffany Paige Gray, Norman Lyn Gray and Nerita Hinkle - all testified to voting for Fannin but also lived outside the district.
