It is a felony to possess or return absentee ballots unless you are the person voting, the voter's family member, a mail carrier, or an authorized official. Herrera convinced four of his neighbors, a deaf brother and sister and two mentally retarded people to sign their absentee ballots and turn them over to him without voting. Both women were named in a December 2012 indictment accusing them of having voted in the 2010 Alton election even though they were not eligible to vote in it. In 2010, a controversy sparked in the small Hidalgo County town when nearly three dozen voters were flagged by the city, which had chosen to run its own election.
