Many landmark decisions have been made recently. Some are steps in the right direction unlike anything we've seen in past years, some are massive considering what we're up against, and one in particular is a generational win.

SCOTUS Reshapes Section 2

In a major decision yesterday, the Supreme Court just redefined how Section 2 of the Voting Rights Act can be used...and who can use it.

For decades, Section 2 has been one of the primary tools used to challenge election laws and district maps on the basis of racial discrimination. This ruling narrows the playing field, limiting the weaponized use of Section 2 and how it can move through the courts.

What this means

What gets passed at the state level is more important than ever. This directly impacts how election laws are contested across the country. With fewer avenues to challenge policies, more responsibility shifts to state legislatures and election officials on the front end.

Where it goes from here

A wave of legislative responses will likely ensue...some states will move quickly to adjust laws, and others will test the boundaries. We already see more subtle attempts legislatively and we suspect that those attempts will turn desperate.

Virginia's One-Two Punch

In a matter of 24 hours, Virginia's redistricting referendum went from a narrow voter victory to a legal standstill.

This constitutional amendment barely skimmed by last Tuesday with mail-in ballots making the difference in a very close race. The amendment would have allowed congressional district maps to be redrawn...a move that could have significantly shifted political representation projected to favor Democrats.

But by the next day, a Tazewell Circuit Court judge has blocked the results from being certified, ruling both the referendum and the bill that triggered it unconstitutional. This isn't the first time the court has weighed in. It had previously flagged the vote as unconstitutional before it even took place, siding with Republicans who filed multiple suits.

Virginia's Attorney General Jay Jones stated his office would appeal the decision which ultimately led to the VA Supreme Court blocking allowing the lower court's decision to stand.

So where does it stand?

Now it heads to a higher court. What appeared settled Tuesday night is now back in question.

Arizona's Power Grab Reversal

A court just shut down a major power shift in Maricopa County. Databases, internal records, and other critical election systems were pulled away from the County Recorder, leaving the election administration unable to do its job.

The ruling?

That move violated the law. Authority assigned by statute cannot be handed off behind closed doors.

How legislation got us here:

AZ laws deliberately splits election duties: recorders handle voter rolls and early voting while the boards manage other operations, and things "break" when those lines are blurred or bypassed. This case is what happens when statutory roles are ignored and the court just reaffirmed: the law still applies.
